"Formaldehyde-free" is a claim you must be able to prove
Regulators do not read the word on the carton; they read the file behind it. A defensible formaldehyde-free claim rests on three documents: the full quantitative formula showing no formaldehyde or releaser, supplier declarations for every raw material, and analytical results confirming free formaldehyde below the method's limit of detection in the finished product.
Note that some preservatives are formaldehyde releasers even though the label name gives no hint. If your specification says formaldehyde-free, the preservative system has to be chosen accordingly — this is a formulation decision, not a labelling one.
Market by market
European Union
Regulation (EC) 1223/2009 prohibits formaldehyde for hair straightening use and restricts releasers. Glyoxylic acid in smoothing has been the subject of ongoing scientific review, and prudent brands are already commissioning glyoxylic-free versions for EU retail. Every product needs a PIF, a signed CPSR and CPNP notification before sale.
United States and Canada
Under MoCRA, facilities register, products are listed and the brand holds safety substantiation on file. Formaldehyde in smoothing products has been the focus of federal rulemaking and state-level restriction, so the practical specification for the US is a formaldehyde-free system with documented substantiation and clear professional-use directions where relevant.
Gulf and wider MENA
Smoothing is a high-volume category across the Gulf. Registration typically requires a certificate of free sale, a certificate of origin, a full ingredient list, and Arabic label content. Halal documentation is frequently requested. Formaldehyde-based products face increasing restriction here too.
Africa and Latin America
Requirements vary by country and often centre on the certificate of free sale, certificate of origin and importer registration. Textured hair dominates demand, which shifts the formulation brief toward higher conditioning load and gentler acid systems rather than maximum straightening power.
How to brief a compliant smoothing line
- Name the destination markets first. The strictest one sets the specification.
- State the excluded chemistry explicitly: formaldehyde and releasers, and glyoxylic acid if your markets require it.
- Define the user: professional salon application or supervised home care. This drives concentration, directions and warnings.
- Define the hair type: virgin, coloured, bleached, chemically relaxed, textured. Bond protection changes with each.
- Set the result target honestly — reduction of volume and frizz control, versus permanent straightening — because the claim must match the substantiation.
- Confirm the documents you need with the file: quantitative formula, MSDS, stability report, challenge test, batch COA, free sale and origin certificates.
Claims that survive scrutiny
- Prefer measured, substantiated claims: frizz reduction, smoothing effect, ease of styling, durability across a defined number of washes.
- Avoid medical or permanent-alteration language unless you hold data that supports it.
- Keep professional-use warnings, ventilation guidance and heat instructions on the label where the system requires heat activation.
- Match the language of the claim to the strongest market's rules, so one artwork can serve several countries.
