Gulf and wider MENA
- Certificate of free sale, usually legalised or attested for the destination.
- Certificate of origin, likewise legalised in several countries.
- Full ingredient list and product specification for registration.
- Arabic label content alongside English, including product function and warnings.
- Halal documentation, requested frequently and decisive in some retail channels.
- Registration through a locally licensed importer or distributor, who is normally the registration holder.
Plan for legalisation time. Attestation of free sale and origin certificates can add weeks that have nothing to do with production, so start the paperwork while the batch is still being made.
United States
- Facility registration and product listing under MoCRA.
- Safety substantiation records held by the responsible person named on the label.
- Adverse event recordkeeping and a US contact address on the label.
- Labelling per FDA rules: identity, net quantity, ingredient declaration, warnings, distributor statement.
- Customs entry with the correct HS classification and, where applicable, FDA prior notice through the entry filer.
Canada
- Cosmetic Notification Form submitted to Health Canada, typically within ten days of first sale.
- Ingredient disclosure using INCI on the label.
- Bilingual English and French label content for mandatory information.
- Compliance with the Cosmetic Ingredient Hotlist.
Africa
Requirements vary widely by country, but a consistent pattern holds: certificate of free sale, certificate of origin, product registration through a locally licensed importer, and clear ingredient and warning labelling in the official language. Several markets require pre-shipment conformity assessment, which must be arranged before the container leaves Santos, not after it arrives.
For high-duty markets, bulk supply in drums with local filling often clears customs faster and cheaper than finished retail goods. It also shortens replenishment cycles once local demand is proven.
A practical sequence
- Confirm destination markets before the formula is locked, so restricted ingredients are designed out from the start.
- Appoint the local legal entity: EU Responsible Person, Gulf importer, US responsible person, Canadian importer.
- Collect technical documents from the manufacturer as production proceeds, not after shipment.
- Run safety assessment and artwork in parallel with stability testing.
- Apply for free sale and origin certificates early, including legalisation where required.
- Notify or register, then ship.
